Police accuse three of DWI
FRIDAY, AUGUST 8, 2008

The following are charged with driving while intoxicated and related offenses:

■ Douglas J. Nellenback, 25, Route 812, Croghan, faces charges of felony DWI, felony aggravated unlicensed operation, having a loud exhaust, having no plate lamp and a seat-belt infraction, cited by state police at 3 a.m. Thursday on Number Four Road in the town of Watson.

Police said he was convicted of DWI twice in 2005, in Oneida County. Troopers listed his test result as 0.12 percent blood alcohol content. State law establishes 0.08 percent BAC as the threshold for intoxication. He also was convicted of another felony, third-degree burglary, in March in Lewis County Court.

His passenger, Jared N.Deveines, 24, Croghan, was cited with harassment and disorderly conduct for directing threats at state troopers, police said.

■ Paul E. Marshall, 51, Clayton, was arrested shortly after 6 p.m. Wednesday by state police at Route 12 and Swan Hollow Road in the town of Alexandria, where he was involved in a two-vehicle collision. He tested at 0.15 percent BAC, police said.

The other driver, Richard J. Sweet, 47, Mattydale, actually was at fault in the accident, a trooper said, and was cited with failure to yield the right of way. Mr. Sweet crossed Route 12, going into the path of the Marshall auto, the trooper said.

■ Angela J. Kondracki, 17, State Street, Carthage, was arrested at 1 a.m. Thursday after being involved in a property damage accident at 71 Bridge St. in West Carthage, according to state police.
