A state Supreme Court lawsuit against Jefferson County Legislator Michael W. Behling over an alleged prank gone awry at the Dulles State Office Building has been discontinued.
Attorneys for Mr. Behling and plaintiff Elizabeth M. "Betsy" Ormsby filed a stipulation of discontinuance of the action Friday at the county clerk's office.
It could not immediately be determined whether there is any kind of settlement agreement. Mr. Behling's attorney, David A. Renzi, Watertown, and Mrs. Ormsby's attorney, Matthew F. Bergeron, Syracuse, were unavailable for comment Monday.
Mrs. Ormsby, wife of county Legislator Barry M. Ormsby, alleged she was duct-taped to a chair while working at the building in April 2006 and then, while bound, sent to several floors on an elevator.
She claimed she complained about the incident to Mr. Behling, the building's superintendent, but was told by him to keep the matter quiet. In exchange for her silence, she alleged, Mr. Behling offered to help her get a promotion.
Mr. Behling, who lost his job in the fallout of the incident, denied any wrongdoing in earlier court filings.
Mrs. Ormsby's suit also named John Burrows, a former employee of Otis Elevator Co.; Jody Towles, a state employee who worked in the State Office Building; Clifford D. James, a building security guard employed by Securitas Security Services USA Inc.; and Securitas. Otis Elevator was dismissed from the suit in April 2007.
Each of the other defendants reached a settlement earlier this year that included signed confidentiality agreements preventing them from disclosing any terms.
Watertown police investigated the incident, but no criminal charges were lodged.
