Lyonsdale man admits to sex with 15-year-old

LOWVILLE — A town of Lyonsdale man admitted in Lewis County Court that he had sexual relations with a 15-year-old girl.

Patrick J. Baumgartner,30, of 4067 Shibley Road, on Wednesday pleaded guilty to second-degree rape, also satisfying another count of second-degree rape, two counts of third-degree rape, eight counts of third-degree criminal sex act and four counts of endangering the welfare of a child. Sentencing for Mr. Baumgartner, who also appeared in court Friday to clear up some presentencing details, was set for Sept. 17.

He was accused of having sexual relations with the teen on several occasions from December through March in the towns of Greig and Lyonsdale.

In other court activity Friday:

Philip G. Bowers,34, of 3028 River Road, Port Leyden, was arraigned on charges of driving while intoxicated and second-degree aggravated unlicensed operation of a motor vehicle and pleaded guilty to both charges. Sentencing was set for Oct. 8. Mr. Bowers was stopped May 10 on Center Street in Lyons Falls.

Jeremy L. Trombly,26, address unavailable, was arraigned on a DWI charge and pleaded guilty. Sentencing was set for Oct. 1. He was stopped Feb. 18 on Route 126 in the town of Croghan.

Thomas E. Peebles,41, of 6943 Wetmore Road, Lowville, was arraigned on charges of second-degree assault, second-degree obstructing governmental administration, third-degree attempted escape, and disorderly conduct and pleaded innocent. His case was adjourned to Oct. 1.

Mr. Peebles was accused March 10 of kicking at the entry door to the Watson Inn and using foul language, then later trying to get away from Lewis County sheriff's deputies and assaulting Deputy Lee M. Todeschini while being taken into Lowville Village Court for arraignment.

Michelle L. Smith,28, of 7576 Cascade Ave., was arraigned on charges of third- and fifth-degree criminal sale of a controlled substance and fourth-degree grand larceny and pleaded innocent. Her case was adjourned to Oct. 8. Ms. Smith was accused of stealing several credit and gift cards Feb. 20 and selling oxycodone and codeine April 8, all in the village of Lowville.

Christopher M. Nugent,22, Canastota, andAlexander W. Eggers,17, address unavailable, both were arraigned on three counts of fourth-degree grand larceny, two counts of third-degree burglary and single counts of third- and fourth-degree criminal mischief and pleaded innocent. Their cases were adjourned to Oct. 8.

Mr. Nugent and Mr. Eggers were accused of breaking into a seasonal camp in the town of Watson and taking a rifle, stealing a van from Beaver Camp in the town of Watson and breaking into the Nice N Easy store in Constableville, all in June.

Mark D. Benson,47, of 7806 Route 3, Harrisville, had his case of aggravated DWI adjourned to Nov. 12, with a possible trial date set for Dec. 13. He was stopped June 6 on Steam Mill Road in the town of Diana.

Derek C. Delles,19, of 6193 Solomon Road, Glenfield, had his case of third-degree burglary and petit larceny adjourned to Oct. 22, with a possible trial date set for Nov. 29. He was accused of breaking into Lyndaker Sales & Service on Cut Off Road in the town of New Bremen on May 26 and stealing cash.

Joshua J. Fatjo,18, of 710 Phelan Drive, Copenhagen, had his case of second-degree assault, second-degree menacing, second-degree attempted assault, first-degree reckless endangerment, first-degree unlawful imprisonment and fourth-degree criminal mischief adjourned to Sept. 17, with a possible trial date of Oct. 25.

Mr. Fatjo was accused Feb. 13 and 14 of cutting Jeremy Cronk with a knife and holding a knife to the throat of Miranda Cronk, threatening to kill her and breaking a cell phone, then later causing a stationary crane to swing in the direction of police officers, all in the town of Denmark.
